    Susanne MacDonald, of SGL Planning & Design Inc. presented the Cannabis Growing Facilities Land Use Review - Recommendation Report to Council at the June 1, 2021 meeting. Council considered the report, made suggested changes and directed the consultants to prepare draft amendments to the Official Plan, Zoning Bylaw and Site Plan Control By-law for a future Public Meeting under the Planning Act.

    City Council passed By-law 2019-76 that Staff carry out a review in respect of the land use planning policies and zoning regulations respecting the use of properties that are zoned for the cultivation, production or processing of cannabis and report to Council with the results and any recommendations resulting from the review.

    Niagara Falls City Council passed a motion to enact an interim control by-law respecting the use of properties for the cultivation, production or processing of cannabis. Section 38 of the Planning Act authorizes the Council of a municipality to pass an interim control by-law where the Council has directed that a review or study be undertaken in respect of land use planning policies in the municipality, or in any defined area or areas thereof.
