On April 30, 2019, Niagara Falls City Council passed a motion to enact an interim control by-law respecting the use of properties for the cultivation, production or processing of cannabis. Section 38 of the Planning Act authorizes the Council of a municipality to pass an interim control by-law where the Council has directed that a review or study be undertaken in respect of land use planning policies in the municipality, or in any defined area or areas thereof.

On June 25, 2019, City Council passed By-law 2019-76 that Staff carry out a review in respect of the land use planning policies and zoning regulations respecting the use of properties that are zoned for the cultivation, production or processing of cannabis and report to Council with the results and any recommendations resulting from the review.

On September 15, 2020, Council passed By-law 2020-93 to extend the Interim Control period until June 25, 2021, in order to complete the study.

The City has hired SGL Planning & Design Inc. to prepare a background report leading to recommendations to regulate cannabis production. The consultants are required to hold a Public Information Centre (PIC) to receive input from the public. Due to COVID-19 and restrictions on gathering, public consultation will occur via Zoom.

  • Online Survey & Public Open House 

    The City hired SGL Planning & Design to conduct a study on the cultivation, processing and possible locations for recreational cannabis operations. A draft report has been prepared (click here) by the consultants which reviews the relevant Federal and Provincial legislation and licencing; discusses the current planning framework in Niagara Falls; examines best practices and standards being used in other municipalities and provides an overview of policy options for Niagara Falls. 

    The Survey and Open House are forums to gather public opinion on the options from the report concerning cannabis as a land use in the City, possible locations and zones where operations may best be suited, potential separation distances from sensitive uses and use of regulations to control cannabis operations. It is hoped that input will be received from operators, proponents and opponents of cannabis.

    Open House: A virtual meeting is schedule for Thursday, November 12, 2020 at 6PM. A PowerPoint presentation will presented by SGL Planning and Design consultants on the Cannabis Growing Facilities report followed by a question and answer period. Persons who want to speak/attend must register in advance with Gwen Donofrio [email protected] . Registrants will be limited to a maximum of 5 minutes.
